Service Agreement Overview

This document outlines the terms and conditions governing your relationship with NaturePest Holistic Pest Control (“NaturePest,” “we,” “us,” or “our”). By signing up for our services, you agree to be bound by these terms.

1. Eligibility and Scope of Coverage

1.1 Property Qualifications

This service plan is strictly limited to well-qualified residential properties. A property is deemed qualified only if it meets all the following mandatory criteria:

  • Property Type: Owner-Occupied, Single-Family Detached Home Only.
  • Home Size: Limited to homes with up to three (3) bedrooms and two (2) bathrooms. Larger homes may require a custom quote.
  • Occupancy Status: The home must be the primary residence of the contracting owner. Rental properties, short-term rentals (such as Airbnb or VRBO), and vacant homes are explicitly excluded.
  • Multi-Unit Exclusions: All multi-unit dwellings are excluded. This includes, but is not limited to, Apartments, Condominiums, Townhomes, Duplexes, Triplexes, and any other structures containing more than one separate residential unit.
  • Mobile Dwellings: Motorhomes, RVs, and trailer homes are also excluded.
  • Foundation: Must have a slab foundation (Crawlspaces are explicitly excluded).
  • Water/Waste System: Must be connected to a municipal sewer system (Septic tanks are explicitly excluded).

2. Covered Pests and Service Inclusions

The recurring service provided under this plan is a general pest control protocol limited exclusively to the control and treatment of the following common household pests:

Wasp Nest Removal: Limited to the removal of Mud Dauber and Paper Wasp nests located at heights of up to 10 feet from the ground.

3. Excluded Pests and Specialized Services

The following pests and specialized services are explicitly excluded from the coverage provided by this recurring plan. Treatment for any of these issues will require a separate, quoted service agreement and fee:

3.1 Excluded Pest Categories

  • Vertebrate Pests: All Vertebrate Pests are excluded, including, but not limited to, Rodents (Mice, Rats, Squirrels), Possums, and Raccoons.
  • Flying Insects: All Bees, Beehives, and all other flying insects not listed in Section 2 are excluded.
  • Wood-Destroying Organisms: Termites (Subterranean, Drywood, etc.).
  • Specialized Interior Pests: Bed Bugs, Fleas, Ticks, and German Cockroaches.
  • Outdoor Vector Pests: Mosquitoes, Flies.
  • Ornamental/Landscape Pests: Lawn Pests and Plant/Shrub Pests.

3.2 Property Exclusions

  • Properties with in-ground swimming pools that require chemical service or maintenance from NaturePest.
  • Properties with extensive landscaping that requires specialized treatment beyond standard perimeter application.

4. Service and Financial Agreement

4.1 Service Schedule and Price Freeze Guarantee

  • Service Commitment (Two-Year Security Plan): This plan requires a mandatory 24-month service commitment from the customer to receive the guaranteed price freeze and initial zero-fee benefits.
  • Service Frequency: Service visits are scheduled every two (2) months, totaling six (6) services per year.
  • Payment Term: A valid credit card must remain on file, and the customer must enroll in AutoPay. Payments are due monthly, regardless of service frequency.
  • Price Guarantee: The matched monthly price of $49.00 is guaranteed to remain fixed for the duration of the 24-month commitment.

4.2 Initial Comprehensive Service

The service begins with our exclusive, comprehensive initial service and property inspection. This includes a thorough interior and exterior assessment, treatment of active pest issues, and identification of potential pest entry points for covered pests. This initial service may include interior treatment as deemed necessary by the technician.

5. Service Scheduling Protocol

5.1 Route-Based Service

All services, including initial services, follow-up services, regular maintenance, and indoor complaint services, are performed only on the specific days NaturePest is operating in the customer’s service area, as part of our optimized route scheduling.

5.2 Appointment Times

  • Initial Services: Will be scheduled with an appointment time.
  • Follow-Up Services (after initial) & Indoor Pest Complaint Services: Appointments for these will be scheduled exclusively when a customer reports an issue for a covered pest.
  • Regular Maintenance Services (Exterior Only): All regularly scheduled maintenance services will be conducted on the exterior perimeter of the property only. No specific appointment time can be given for exterior maintenance services.

5.3 Property Access Requirements

  • Exterior Access: The property must be fully accessible for our technicians during standard service hours, between 8:00 AM and 6:00 PM, on the notified service day. This includes unlocked gates or any other barriers preventing access to the exterior perimeter.
  • Denied Access / Turn-Away Fee: If a property is locked, access is denied (e.g., gates are inaccessible), or the technician is turned away from the community (e.g., by security), a $49.00 Service Fee will be automatically charged to the credit card on file. This fee covers the cost of the missed service attempt and necessary rescheduling.

5.4 Free Follow-Ups and Inter-Service Calls

This plan includes free follow-up services as needed, and free services in between regularly scheduled maintenance visits for any covered pests (as defined in Section 2). If a recurrence of a covered pest is observed between scheduled bi-monthly service dates, the customer must notify NaturePest, and the company will schedule a return service visit at no additional charge to resolve the issue.

6. Terms of Cancellation

6.1 Cancellation Rights

The customer has the right to cancel the recurring service plan at any time.

6.2 Zero Upfront Fees

All initial setup fees and the cost of the first 30 days of superior service are waived for the customer’s benefit.

6.3 The Convenience Fee

Should the customer terminate the agreement (including the 24-month commitment in the Two-Year Security Plan) for any reason after the initial 30-day period, a $249.00 Convenience Fee will be automatically charged to the credit card on file. This fee is not a penalty; it is a simple, transparent fee that:

  1. Recovers the administrative costs associated with establishing the account, waiving the initial fees, and locking in the discounted rate.
  2. Protects the value of the superior initial service and ongoing price security provided by NaturePest.

6.4 Payment Requirement

By signing this agreement, the customer authorizes NaturePest to charge the $249.00 Convenience Fee immediately upon cancellation.

7. Price Match Terms

The Price Match Guarantee is subject to the following conditions:

  1. Written Proof: The competitor’s price must be presented to NaturePest in the form of a verifiable, written estimate or agreement.
  2. Identical Service Model: The competitor’s quote must be for a recurring general pest control service with a frequency comparable to the services offered by NaturePest. Prices for one-time services or bundled plans are excluded.
  3. No Discounts: The competitor’s quoted price must be their standard pricing and cannot include promotional discounts, rebates, or temporary offers.
  4. Service Area: The competitor must service the same geographic area as NaturePest.
  5. Time Limit: Price match requests must be submitted within 30 days of the competitor’s quote date.

8. Liability and Limitations

8.1 Service Guarantee

NaturePest guarantees its services against recurrence of covered pests between regularly scheduled service visits. If a covered pest problem recurs between visits, NaturePest will return to address the issue at no additional charge.

8.2 Limitation of Liability

NaturePest’s liability for any claim relating to its services is limited to the total amount paid by the customer for services in the six months preceding the claim. NaturePest shall not be liable for any incidental, consequential, or special damages.

8.3 Force Majeure

NaturePest shall not be held responsible for delays or failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, or severe weather conditions.

8.4 Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising from this agreement shall be resolved in the courts of Broward County, Florida.
